City Attorney
Jason Whalen is the City Attorney for Auburn.  

Jason brings over 32 years of private and public legal experience to his role as City Attorney, as well as over 16 years of municipal experience in Lakewood, WA, serving as an elected councilmember, deputy mayor, and currently, as mayor.  Prior to joining Team Auburn, Jason served as a Deputy Prosecuting Attorney for Pierce County, in its Civil Division, providing real estate expertise for various Pierce County departments.  A graduate of Gonzaga University, Jason served in the U.S. Army as a Field Artillery officer in Germany, prior to the fall of the Berlin Wall.  Upon completion of his ROTC commitment, Jason returned to Gonzaga for law school and later served as law clerk to Justice Richard P. Guy of the Washington State Supreme Court.

The City Attorney’s Office represents the City in its day-to-day operations and provides legal advice to the Mayor, City Council, Administration, and boards and commissions that make up the municipal government of the City of Auburn. The City Attorney’s Office does not provide legal advice to residents of Auburn or members of the general public.  


The Legal Department has four divisions:  Civil, Prosecution, City Clerk's Office, and Real Estate division.

Civil Division

The Civil Division is responsible for providing legal counsel and representation to the City's elected and appointed officials.  Its duties include:

  • Preparing legislation
  • Drafting and reviewing legal documents
  • Representing the City in litigation

Prosecution Division

The Prosecution Division is responsible for the prosecution of criminal misdemeanors, traffic infractions, and code enforcement violations filed in the King County District Court - South Division, Auburn Facility

The Prosecution Division represents the interests of the public as a whole and does not represent individuals.  The attorneys and staff employed by the office are prohibited from providing any legal advice to private individuals.

Real Estate Division

The primary focus of the Real Estate Division is to represent the City in real estate matters. Its responsibilities are divided into three main categories: 1) sales and leasing, 2) property rights and management, and 3) special projects. The division does not provide real estate advice or represent citizens of Auburn, or individuals with real estate interests in Auburn.

The City Attorney’s office does not have a domestic violence victim advocate. The City Attorney’s Office has a domestic violence paralegal who coordinates criminal case-related issues with victims. The paralegal can be reached at 253-931-3072 or by email
